THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22358 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as fair price shop dealer of shop No.25 of Jakkalacheruvu village, Gooty Mandal, Anantapuramu District. While so, a show cause notice was issued by the 2nd respondent to the petitioner on 24.03.2015 framing two charges and the petitioner submitted his explanation.

After receiving the explanation, the authorization of the petitioner was suspended by order dated 04.04.2015. Challenging the same, the petitioner filed an appeal before the 4th respondent, who passed an order on 08.05.2015 directing the 2nd respondent to dispose of the main case itself within six weeks duly providing an opportunity of hearing to the petitioner. When the main case is not disposed of by the 2nd respondent within the time stipulated by the 4th respondent, the present writ petition is filed.

In view of the pendency of the case before the 2nd respondent after submission of explanation by the petitioner, this Court is not inclined to interfere with the enquiry process at this stage. However, the 2nd respondent is directed to complete the enquiry and pass final orders within a period of thirty days from the date of receipt of a copy of this order and the petitioner shall cooperate with the completion of enquiry.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. _________________________ A.RAMALINGESWARA RAO, J Date: 20.07.2015 siva
