HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11775 OF 2013 ORDER:
This petition is filed for a writ of Mandamus declaring the impugned Notification issued by the 5th respondent dated 03.04.2013 bearing Rc.No.220/G3/MS/13, inviting tenders from outsourcing agencies, without passing any orders on the application of the petitioner dated 13.02.2013 for renewal of its license as per G.O.Rt.No.2246, dated 07.06.2007, as illegal and arbitrary and consequently to set aside the said notification. The impugned notification is of the year 2013. Though the petitioner sought interim order, this Court has not granted any interim order.
The 4th respondent filed counter stating that the petitioner's application for renewal could not be considered since the respondents have not satisfied with the performance of the petitioner during the term 2010-2013 for which the petitioner was granted tender in the earlier occasion and that the District Level Committee headed by the District Collector, Krishna District has selected M/s.Rahul Youth Association, Machilipatnam, strictly as per the rules and the said agency is now working with utmost satisfaction of the respondents. In view of the same, nothing survives for adjudication in the writ petition. Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
