This writ petition filed under Article 226 of the Constitution of India assails the order of cancellation of the authorization of the fair price shop of the petitioner issued by respondent No.3 vide proceedings Ref.B./721/2016, dated 22.08.2016. 2.

Heard Sri S.Dushyanth Reddy, learned counsel appearing for the petitioner, and the learned Government Pleader for Civil Supplies (A.P.) appearing for the respondents. 3.

Admittedly, as against the said order of cancellation, the petitioner herein has filed an appeal on 19.09.2016 under the provisions of the A.P. State Public Distribution System Control Order, 2008. According to the learned counsel for the petitioner, no orders have been passed on the said appeal by respondent No.2.

Having heard the learned counsel for the petitioner and the learned Government Pleader for the respondents, this Court deems it appropriate to dispose of the writ petition by directing respondent No.2 to pass appropriate orders on the appeal, dated 19.09.2016, preferred by the petitioner herein against the order of cancellation passed by respondent No.3 vide proceedings Ref.B./721/2016, dated 22.08.2016, within a period of two (2) months from the date of receipt of a copy of this order. Till then, the operation of the impugned order is suspended.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
