CRIMINAL PETITION NO. 17221 OF 2016 O R D E R :
This Criminal Petition is filed by the petitioner/accused under section 437 and 439 of Cr.P.C., seeking to enlarge him on bail in Crime No. 125 of 2016 of Singarayakonda Police Station, Prakasam district, registered for the offences punishable under section 376 of IPC section 6 of the Protection of Children from Sexual Offences Act, 2012, Section 3 [1] [r] [s] [w], section 3 [2] [v] [Va] of SCs and STs [POA] Act, 1989.
2. For the same relief, the petitioner earlier filed bail application vide Criminal Petition No. 16285 of 2016 and the same was dismissed vide order dated 25/11/2016.
3. Learned counsel appearing on behalf of the petitioner submits that after dismissal of the first bail application, thereafter, charge sheet was filed on 14/12/2016.
4. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the said petition with liberty to approach the trial court.
5. Permission is accorded with liberty as prayed for.
6. The Criminal Petition is accordingly dismissed, as withdrawn.
7. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
