HON'BLE SRI JUSTICE S.V. BHATT W.P.No.18130 OF_2018 ORDER:

Heard learned counsel for petitioners and the Assistant Government Pleader (Revenue) for respondents. The petitioners pray for Mandamus declaring the threatened dispossession of petitioners from the land measuring Ac.2-42 cents, Ac.0-21 cents and Ac.0-07 cents in Sy.Nos.21/ 8, 21/ 9 and 21/ 10 respectively of Gundla Kattamanchi Village, Bangarupalem Mandal, Chittoor District, as illegal, arbitrary and unconstitutional. The petitioners state that Tahsildar/ 3rd respondent cancelled the assignment granted to them earlier. Aggrieved, the petitioners filed appeal before the Joint Collector, Chittoor. The Joint Collector cancelled the assignment. Thereafter, the petitioners carried the matter by way of revision before the Chief Commissioner of Land Administration (CCLA).

The CCLA remanded the matter to the Joint Collector for appropriate orders. The Joint Collector, without considering the explanation and remand order of CCLA, again cancelled the assignment. Against cancellation of assignment by the Joint Collector, the petitioners again filed revision before the CCLA. The revision is yet to be disposed of.

(b) status quo as regards possession and enjoyment is directed to be maintained during the pendency of the revision.

The writ petition is, accordingly, disposed of as indicated above. There shall be no order as to costs.
