THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2903 of 2017 ORDER:

This Criminal Petition under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioners/A.1 and A.2 on pre-arrest bail since they are apprehending arrest in connection with Crime No.6 of 2017 of Jiyyammvaloasa Police Station, Vizianagaram District, registered for the offences under Sections 3 (1) (x) of SCs and STs (POA) Act 1 of 2016 and Sections 477, 435, 506 r/w 34 IPC. After arguing the matter for a while, learned counsel for the petitioners requested this Court to permit the petitioners to surrender before the concerned Court and direct the concerned Court to decide the application, if any, filed by the petitioner under Sections 437 and 439 Cr.P.C. on the same day.

Acceeding to the request of learned counsel for the petitioners, without going into the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Special Judge for trial of offences under SCs and STs (POA) Act and on such surrender, if any application is filed under Section 437 and 439 of Cr.P.C, after serving notice on the Public Prosecutor, the Special Judge of the concerned Court is directed to decide the application filed by the petitioners on the same day in accordance with law.

With the above observation, this Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
