THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.17746 of 2014 in Crl.P.No.16479 of 2014 and Crl.P.No.16479 of 2014 Common Order:
The defacto complainant and her counsel Sri K.Narsi Reddy are present. Accused and their counsel Sri M.K.Raj Kumar are present.
Heard both sides and perused the petition.
The Police of Sanjeevareddy Nagar P.S have filed charge sheet in FIR No.1432 of 2010 against the accused for the offences under Section 498-A, 506 IPC and Sec. 4 and 6 of Dowry Prohibition Act and the learned XIII Additional Chief Metropolitan Magistrate, Nampally took cognizance of the same and registered in C.C.No.433 of 2011.
Now the submission of both sides is that at the intervention of elders, both parties have settled their disputes and the defacto complainant and Accused No.1 proposed to live together happily and hence they entered into a compromise and so permission may be accorded to them to enter into compromise and quash the proceedings in C.C.No.433 of 2011 on the file of XIII Additional Chief Metropolitan Magistrate, Nampally in the interest of justice.
Having regard to the above submission and
considering the fact that it is a matrimonial matter wherein the parties have amicably settled their disputes and entered into a compromise and no useful purpose will be served even if the parties are driven to trial and on the other hand, the trial will be a counter project to their happy married life and also following the decision reported in Gian Singh v. State of Punjab and another[1], permission is accorded to compromise the matter and compromise is recorded in terms of the compromise petition and consequently the proceedings in C.C.No.433 of 2011 on the file of XIII Additional Chief Metropolitan Magistrate, Nampally are hereby quashed.
In the result, both the petitions are accordingly disposed of.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
