THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.6707 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ of mandamus or any other appropriate writ order or direction declaring the orders vide Rc.No.420/2015 CS, Dt.31.03.2015 passed by the 3rd respondent in suspending the petitioner's F.P.

shop authorization without conducting any enquiry and without affording any opportunity is illegal, arbitrary and set aside the same and consequently direct the respondents to continue the petitioner as Shop No.1 Peddatamarapally Village, Nandigam Mandal, Srikakulam District."

Heard the learned counsel for the petitioner and learned Government Pleader for Civil Supplies for the respondents. 3.

According to the petitioner, he is a fair price shop dealer of Shop No.1 of Peddatamarapalli Village, Nandigam Mandal, Srikakulam District. The Revenue Divisional Officer, Tekkali3rd respondent herein, by way of an order dated 31.03.2015, vide proceedings Rc.No.420/2015 CS, suspended the fair price shop authorization of the petitioner herein pending finalization of the enquiry.

Aggrieved by the said order of suspension, petitioner herein preferred appeal before the Joint Collector,

AVSS,J W.P.No.6707 of 2017 Srikakulam, vide S.R.A.No.15/2015, dated __.05.2015. The said appeal, according to the learned counsel for the petitioner, is not yet disposed of and in view of the same, the petitioner herein is put to lot of inconvenience and hardship, besides losing his livelihood.

Having heard the submissions of the learned counsel for the petitioner, this Court deems it appropriate to direct the 2nd respondent - Joint Collector, to dispose of the said appeal by fixing some timeframe.

For the aforesaid reasons, this writ petition is disposed of, directing the Joint Collector, Srikakulam - 2nd respondent herein, to dispose of the appeal vide S.R.A.No.15/2015, dated __.05.2015, filed by the petitioner against the orders of the Revenue Divisional Officer, vide Rc.No.420/2015 CS, dated 31.03.2015, in accordance with law, within a period of three weeks from the date of receipt of a copy of this order, after giving notice and opportunity of hearing to the petitioner herein.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
