THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.18633 of 2015 ORDER :
The petitioner claims to be the owner of land to an extent of 333.33 Square yards in Survey No.1672 of Bhagyanagar, Nirmal Mandal, Adilabad District. The petitioner alleges that highhandedly the Nirmal Municipality has put up a board disclosing as if the property belongs to it, whereas, the property is owned and is in possession of the petitioner. Hence, this writ petition.
2. As the averments in the writ affidavit itself would disclose that there is dispute regarding ownership of the land in issue claiming that the land belongs to the municipality and that a notice is put up by the Municipality. If the petitioner claims that the said property belongs to him, he has to establish his title and ownership by initiating appropriate proceedings under civil law. Obviously, there are rival claims on the property in issue, and this Court cannot adjudicate the rival claims and cannot decide the title dispute in exercise of extra ordinary jurisdiction under Article 226 of the Constitution of India. Thus, leaving it open to the petitioner to work out his remedies, as available in civil law, this Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
