HON'BLE SRI JUSTICE S.V. BHATT W.P. No.18162 OF 2018 ORDER:

The petitioners complain against laying of road through Survey Nos.348-2, 348-2B and 352 of Jarugumalli Village and Mandal, Prakasam District, without recourse to law, as illegal, arbitrary and unconstitutional.

The Assistant Government Pleader places on record the written instructions dated 30.05.2018. The operative portion reads thus:

"It is further submitted that as per RSR of Zarugumalli revenue village, the above lands covering under pathway to burial ground utilizing by Adi Andhra colony people are classified as patta lands. In the reference 2nd cited, the basic values and sales statistics for the above lands were submitted to the Revenue Divisional Officer, Kandukur for payment of compensation to the land owners for pathway to burial ground to them under New Land Acquisition Act 30 of 2013. The process of obtaining land for pathway to burial ground purpose is in progress."

From the above, it is clear the respondents are contemplating to acquire land by following the procedure under Act 30/ 2013. The instructions further refer to payment of compensation to the affected land owners. The statement is placed on record and the writ petition is disposed of directing the respondents not to interfere or change the physical features of patta land of petitioners except in accordance with law.

No order as to costs.
