2019-09-30P Naveen Rao3 pages

Date: 30.9.2019 Between :

Marupaka Narayana Petitioner And State of Telangana, rep. by its Principal Secretary, Panchayat Raj and Rural Development Department, Secretariat Building, Hyderabad & others.

Respondents This court made the following :

ORDER :

Petitioner is working as Field Assistant in Raikal Mandal, Tatlawai village under Mahatma Gandhi National Rural Employment Guarantee Scheme. On 21.5.2018, petitioner was placed under suspension on the allegation of financial irregularities. He also served with show cause notice, asking him to submit explanation as to why further action should not be taken against him. 2.

According to the learned counsel for petitioner, petitioner filed explanation within the time granted and thereafter there is no progress in the matter and continuing him under suspension is causing great hardship to the petitioner. The contention that so far no decision is taken on further continuation of suspension of petitioner and disciplinary action is not concluded is not disputed. 3.

In view of the same, the writ petition is disposed of, directing the 3rd respondent to conclude disciplinary action in pursuant to the show cause notice dated 21.5.2018 as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. If for any reason, disciplinary proceedings are not concluded within the time stipulated not attributable to the petitioner, the petitioner shall be reinstated into service. Pending miscellaneous petitions shall stand closed. No order as to costs. __________________ P.NAVEEN RAO,J Date: 30.9.2019 DA
