THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 3218 OF 2015 ORDER:

Heard the learned counsel for the petitioner as well as the learned Standing Counsel appearing for respondent No.2. 2.

The prayer sought in the Writ Petition is as under: " ....to issue an appropriate Writ, order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in proceedings with the construction activities by encroaching the road margin Chembakur to State Border via Nariganipalli in S.No.68 of Chembakur village, Ramasamudram Mandal, Chittoor District duly closing ingress and out-gress of petitioners site to an extent of 1830 sq. feet in S.No. 65/ 1 as illegal, improper, unjust, arbitrary and contrary to law and further direct the respondents to stop the constructions."

During the course of hearing, on the basis of the submissions made by the learned Standing Counsel with regard to the completion of the construction, learned counsel appearing for the petitioner submits that liberty may be given to him to approach the proper Forum for redressal of his grievances in the event if his rights are violated.

Taking into consideration of the said submission, the Writ Petition is dismissed.

It is needless to observe that if the rights and interests of the petitioner are prejudiced, it is always open for him to pursue the remedies available to him as per law.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
