HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5962 of 2019 ORDER :

This Criminal Petition under Section 438 of Cr.P.C. is filed by the petitioners/A7, A9 and A10, seeking anticipatory bail in Crime No.111 of 2017 on the file of the S.H.O. Raidurgam Police Station, Cyberabad District, registered for the offences punishable under Sections 420, 406, 468, 471, 474,447, 427, 120-B and 201 IPC.

2. Heard learned counsel for the petitioners as well as the learned Additional Public Prosecutor appearing for respondent-State.

3. Learned counsel for the petitioners submits that the petitioners are innocent persons and they have nothing to do with the alleged offences and they have no criminal antecedents. The petitioners are no way connected with the crime as alleged by the de facto complainant. The petitioners are eking out their livelihood as labourers. Due to this case, the petitioners families shocked and the police are unnecessarily implicated a case against them. The entire family is depending upon the income of the petitioners.

4. On the other hand, the learned Additional Public Prosecutor representing the State vehemently opposed the bail application.

As seen from the contents of the FIR, there are allegations that these petitioners along with other accused under the name of Pragathi Nagar Social Organization created fake documents and dishonestly claiming the property and they have committed cheating, criminal breach of trust and forgery etc., 6.

Taking into consideration the nature of allegations made against the petitioners and the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners.

Accordingly, the Criminal Petition is dismissed. However, the petitioners-A7, A9 and A10 shall surrender before the concerned Court within 3 weeks from today and move bail application and the same shall be considered in accordance with law. Miscellaneous petitions, if any pending, shall stand closed.
