Heard learned counsel for the petitioner and learned Government Pleader for respondents.

The present writ petition is filed by M/s.Sri Balaji Rice and Flour Mill, represented by its Managing Partner. The petitioner has been in the business of custom milling of paddy of the Civil Supplies Corporation. The Enforcement Deputy Tahsildar and other Vigilance authorities inspected the rice mill on 08.07.2015 and seized the available stock of paddy, vehicle (lorry) and also rice in the lorry. The third respondent passed an order on 05.10.2015 ordering to dispose of the seized rice through public auction. Challenging the same, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that the petitioner is willing to furnish security for the release of the stock. For release of the seized stocks, the petitioner also filed a petition on 08.10.2015 before the third respondent. In the circumstances, the third respondent is directed to consider the application of the petitioner dated 08.10.2015 for release of the seized stock pursuant to inspection of the petitioner's rice mill conducted on 08.07.2015 and pass appropriate orders in accordance with law within a period of one week from the date of receipt of a copy of this order. In the meanwhile, the order passed by the third respondent dated 05.10.2015 directing the fifth respondent to dispose of the seized stock through public auction shall stand suspended.

The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. ________________________________ (A.RAMALINGESWARA RAO, J) 14.10.2015 vs
