2015-09-22R.Kantha Rao2 pages

HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.30783 OF 2015

ORDER

Heard learned counsel on either side.

Charge sheet was issued to the petitioner levelling certain allegations, for which, he submitted his explanation. Thereafter, the 3rd respondent-Project Director conducted enquiry and removed the petitioner by order dated 18.03.2015. Hence, the present writ petition is filed seeking to set aside the removal order on the ground that it is illegal and passed in violation of principles of natural justice. However, the petitioner preferred an appeal before the 2nd respondent-Commissioner and the same is pending.

In view of the same, I am not inclined to go into the merits of the case.

Accordingly, the Writ Petition is disposed of directing the 2nd respondent to hear the appeal and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
