HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5586 OF 2018 ORDER:

The petitioners are A1 & A2 in Crime No.144 of 2018 on the file of Tenali II Town Police Station, Tenali, Guntur District. The crime registered is for the offences punishable under Sections 420, 380, 506 r/w 34 IPC. 2.

The petitioners are no other than the eldest daughter and son-in-law of the de facto complainant. The petitioners by saying as innocently purchased the property covered by the unregistered possessory Sale Agreement dated 03.02.2015 from the de facto complainant by alleged cash payment of more than Rs.1.20 Crores and obtained agreement and issued notice on 16.05.2018. The contention of the petitioners therefrom is that it is a false report dated 21.05.2018 of the de facto complainant in registration of the crime by the Tenali II Town Police after serving of the notice. 3.

In fact, suffice to say from the perusal of the agreement and the modus operandi and from prima facie accusation of the petitioners-A1 & A2 are not entitled to the concession of anticipatory bail.

Dr. SSRB,J Crl. P.No.5586 of 2018 In the result, this Criminal Petition is dismissed. It is needless to say the Tenali II Town Police, Tenali, are directed to follow the procedure under Section 41-A Cr.P.C.
