HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.2575 of 2015 ORDER:
The instant petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, requesting the Court to quash the proceedings in C.C.No.355 of 2014 on the file of Judicial Magistrate of First Class, Guntakal, Anantapur District, against the petitioner - accused No.2 (Smt Chowdam Chandravathi), who is the mother of accused No.1 and, admittedly, the mother-in-law of the first respondent - complainant, for the offences punishable under Section 498-A read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act.
Heard both sides.
Learned counsel for the petitioner submits that the complaint allegations would not reveal anything in the direction of proving the alleged acts of cruelty said to have meted out to respondent No.1 by the petitioner herein except the allegation that accused Nos.1 and 2 started showing their sadistic nature towards the complainant. It is also his submission that the petitioner - A.2 is living at Yemmiganur Town, Kurnool District and never resided with accused No.1 and the complainant, and there was no occasion to join accused No.1, and harass the complainant. Learned Additional Public Prosecutor appearing for the Andhra Pradesh State, on instructions, submits that the petitioner - A.2 resided with accused No.1 under the same roof. However, keeping in view, that there is one allegation, and
the matter is pending on the file of Judicial Magistrate of First Class, Anantapur District, and since the address of the petitioner is shown at a particular residence in Yemmiganur Town, Kurnool District, her presence in the proceedings in C.C.No.355 of 2014 on the file of Judicial Magistrate of First Class, Guntakal, Anantapur District, is dispensed with. However, the petitioner shall appear before the learned Magistrate as and when directed by the learned Magistrate.
The Criminal Petition is, accordingly, disposed of. As a sequel thereto, miscellaneous applications, if any, also stand dismissed.
