THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.2647 of 2007 ORDER :

This writ petition is filed to declare the action of the respondents in seeking to retire the petitioner from service w.e.f.31.10.2007 as illegal, arbitrary and set aside the same and consequently direct the respondents to continue the petitioner in service till 31.08.2009 or in the alternative and refer the petitioner to the APEX Medical Board for assessment of his age in terms of Circular No.P.49/4702/IR/1270 dated 01.08.1988 issued by the 1st respondent.

When the matter is taken up, learned counsel for the petitioner represents that the cause in the writ petition does not survive.

Recording the said submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
