Sri T.P.Acharya, learned counsel for the petitioner seeks permission to withdraw the petition. Permission is accorded.

2) Therefore, this petition is dismissed as withdrawn with a liberty to file an application under Section 227 Cr.P.C for discharge before the trial Court if there are no grounds for framing of charge in the course of hearing under Sections 226 to 228 Cr.P.C by the learned Sessions Judge and the same shall be decided on own merits basing on the prosecution material vide State of Orissa V. Debendranath Padhi[1].

3) Miscellaneous petitions, if any pending, shall stand closed.
