THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7435 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.33 of 2023, on the file of Amrabad Police Station, Nagarkurnool District, registered for the offences under Sections 420, 376 and 312 of IPC and Section 5 r/w. Section 6 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The de-facto complainant lodged a complaint alleging that she knew the petitioner since 4 years and they were in love. During the course of their friendship, she became pregnant, thereafter, aborted. However, she came to know that this petitioner was engaged with some other girl. Having found the wedding photo of one Sushmitha and this petitioner, the complaint was filed.

Learned Additional Public Prosecutor on instructions would submit that charge sheet is already filed. The petitioner is now aged about 19 years. 5.

Even according to the de-facto complainant, the grievance is that petitioner did not marry her and therefore, she has filed a complaint. In the said circumstances, the petitioner can be granted relief of regular bail subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Achampet.

ii) The petitioner after release shall appear before the concerned Court on every date of hearing. iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
