THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.1111 of 2006 JUDGMENT:

This appeal is filed under Order XLIII Rule 1 C.P.C. assailing the order dated 10.10.2006 passed in I.A.No.363 of 2005 in O.S.No.52 of 2005 on the file of the Court of the Senior Civil Judge, Kavali.

Heard the learned counsel for both parties.

At the time of hearing, learned counsel for the first respondent submitted that the trial Court decreed O.S.No.52 of 2005 two years back.

In view of the submission made by the learned counsel for the first respondent, no purpose will be served by keeping the appeal pending.

Hence, the Civil Miscellaneous Appeal is dismissed as infructuous. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
