HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5403 OF 2017 ORDER:

The grievance of the petitioners is that frequent visit of respondent - authorities to the land in Sy.No.350, Markapur Revenue Village claiming that the subject land belongs to respondent No.3 - Temple.

Petitioners filed documents evidencing prima facie title viz. sale deed obtained in 1995; and pattadar pass books granted by the revenue - authorities. Even, in the sale deeds obtained by the petitioners, details of predecessors and their title are also set out. Even assuming for argument sake that the subject land belongs to respondent No. 3 - Temple, respondent - authorities cannot interfere with the peaceful possession and enjoyment of petitioners without following due process of law.

The said legal position is not disputed by Sri A.Srikanth Reddy, learned Standing Counsel for respondent No.3 - Temple. He would submit that respondent - authorities would take action only in accordance with law.

In the circumstances, Writ Petition is disposed of with a direction to respondents not to interfere with the peaceful possession and enjoyment of the petitioners in

respect of the subject land without following due process of law.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
