THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43604 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in implicating the petitioner as A-22 in proceedings in FIR No.282 of 2016, as illegal and arbitrary.
Heard and perused the material available on record. The case of the petitioner is that one Deepak Kanth Vyas came to the petitioner's office in Choutuppal and exhibited all link documents, pattadar passbooks, title deed pertaining to the land admeasuring Ac. 24.01 guntas in Survey Nos.567, 569 and 583 of Raghavapuram Village of Bibinagar Mandal and paid necessary fees for registration or execution of agreement of sale cum General Power of Attorney in favour of one Jithender Kumar Bandari Jain of Hyderabad and after necessary verification be accepted to register the document No.2813 of 2016, dated 13.05.2016 and that basing on the said document, the agreement holder Jithender Kumar Bandari Jain had executed a sale deed in favour of Gillela Ravindra Reddy and Mallipeddi Aravind Reddy vide Document No.
3157 of 2016 and that the original land owner Deepak Kanth Vyas approached the petitioner and complained that an unknown person impersonated as Deepak Kanth Vyas and executed the above agreement of sale cum General Power of Attorney vide Document No.2813 of 2016 by forging and impersonating. The main grievance of the petitioner is that at the time of arrest of A-17, A-18 & A-19, in the remand report, dated 06.12.
on the confession statement, dated 06.12.2016, stated to be confessed by A-18.
Learned counsel for the petitioner contended that the petitioner's name was not mentioned in the first remand report, dated 03.12.2016, later the petitioner's name is shown as A-22 in the second remand report, dated 06.12.2016, and submitted that the petitioner is intentionally involved in the said crime. Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the 2nd respondent is directed to complete the investigation in FIR No.282 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
