THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.364 and 436 of 2017 COMMON ORDER:

These Civil Revision Petitions are filed by the petitioners/Claimant Nos.2 and 3, challenging the Orders in I.A.No.61 of 2016 in L.A.O.P.No.151 of 2009 and I.A.No.60 of 2016 in L.A.O.P.No.143 of 2009, dated 29.11.2016, passed by the learned Principal Senior Civil Judge, Nellore. 2) The petitioners filed the I.A.No.61 of 2016 in L.A.O.P.No.151 of 2009 and I.A.No.60 of 2016 in L.A.O.P.No.143 of 2009 under Order VI Rule 17 r/w Sec.

151, 152 and 153 of Code of Civil Procedure (in short "CPC") seeking amendment of the surnames of the petitioners/2nd and 3rd claimants in the Awards passed by the Land Acquisition Officer-Cum-Revenue Divisional Officer, Nellore, the Court below had come to conclusion that the amendment, which is sought, has not been falling within the scope of Order VI Rule 17 r/w Section 152 and 153 of CPC, such amendment cannot be amended. I see no reason to interfere with the impugned orders. 3) Accordingly, these Civil Revision Petitions are dismissed. The dismissal of the CRPs shall not be construed as preventing the petitioners to approach the appropriate competent authority seeking amendment, which they sought in the present Interlocutory Applications dismissed by the Court below. No costs.

4) Consequently, the miscellaneous petitions pending, if any, shall also stand dismissed.
