HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE NO. 1426 OF 2008 ORDER:

Heard the learned Public Prosecutor for the petitioner. However, the learned counsel appearing for the respondents filed a letter before the Registrar of this Court requesting to post the above said criminal revision case. In the said letter, it is mentioned that the present revision case is filed by the prosecution against the orders passed in Crl.M.P.No.91 of 2005 in C.C.No.16 of 2005 wherein it sought to attach the properties of the accused. After filing of the said revision case, the main case i.e. C.C.No.16 of 2005 was disposed of by the learned Metropolitan Sessions Judge on 13.06.2008 and acquitted the accused. Aggrieved by the said orders, the prosecution filed an appeal before this Court vide Crl.A.No.1766 of 2009 and the same was also dismissed by this Court on 05.10.

2018 and thereby the criminal revision case has become infructuous. Though the acc used was ac quitted, he is unable to receive the original doc uments on the ground that the above said criminal revision case is pending. The said facts are not disputed by the learned Public Prosecutor. In that review of the matter, this Court is of the opinion that no further cause would survive in the present criminal revision case and it has become infructuous by disposal of C.C.No.16 of 2005 on 13.06.2008 and Crl.A.No.1766 of 2009 on 05.10.2018.

Ac c ordingly, the criminal revision case is dismissed as infructuous. Miscellaneous petitions, if any pending in this criminal revision case shall stand closed.
