HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5597 OF 2018 ORDER:

Heard learned counsel for petitioners-A.1 & A.2 in crime No.22 of 2018 of Women Police Station, Chittoor, Chittoor District, registered for the offences punishable under Sections 498-A, 354-A(1)(ii) & 354-C IPC and Sections 3 & 4 of Dowry Prohibition Act and the learned Public Prosecutor representing the State and perused the FIR, contents of the bail application and other material on record.

A perusal of the record no way entitles to the concession of anticipatory bail to the petitioners. However, it is made clear that as none of the offences are punishable above seven years, the Police in the event of arrest strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1.

Accordingly and in the result, this Criminal Petition is disposed of.
