HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 14208 of 2016 ORDER:

The petitioner was appointed as Casual Driver in the respondent Corporation in the year 1994 and his services were regularized with effect from 31.7.1995. While so, he suffered Cervical disease and thereby he was referred to undergo medical examination before the Medical Officer, APSRTC Dispensary, Hindupur. The Senior Medical Officer, Hindupur

declared the petitioner unfit to the post of driver. Thereafter his case was referred to the Chief Medical Officer, APSRTC Hospital, at Tarnaka, Hyderabad, for medical re-examination, who also declared that the petitioner is unfit for the post of A1 Category driver and also unfit for all other categories as per Medical Standards of APSRTC. When the second respondent issued order dated 1.4.2016 ordering to retire from service on medical grounds with effect from 10.2.2016, the petitioner filed the present Writ Petition.

The learned Counsel for the petitioner submits that though the Medical Officer declared the petitioner unfit to the post of A1 Category Driver, however, his case was not considered for any alternative post.

This Court did not find any representation submitted by the petitioner to the respondent authorities seeking such request for alternative employment.

In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit a representation seeking alternative employment and as and when the petitioner files such representation, the second respondent shall consider the same and pass appropriate orders in accordance with law within a period of three months from the date of receipt of the representation from the petitioner.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
