THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22133 of 2016 ORDER:
The petitioner states that she is a resident of Aswaraopeta Village in Khammam District. She belongs to Backward Caste community. She submitted an application in the year 2014 to the respondents to provide employment in the Sarva Siksha Abhiyan. She was appointed as Messenger on contract basis during the academic year 2014-2015. The same was extended for the years 2015-2016 and 2016-2017. When the second respondent issued proceedings on 28.06.2016 engaging respondent No.5 in the place of petitioner and transferring the petitioner to another place, the present Writ Petition is filed.
A reading of the impugned order shows that respondent No.5 is a Scheduled Tribe candidate and belongs to scheduled area. Accordingly, the Mandal Educational Officer, Aswaraopeta Mandal, was directed to engage him as Messenger in the place of the petitioner, and the petitioner was asked to work under the control of the Mandal Educational Officer, Kalluru. Since, it is an administrative order, this Court is not inclined to interfere with the said order.
The Writ Petition is, accordingly, dismissed at the admission stage. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
