Writ Appeal No.881 of 2015 And Writ Petition No. 29124 of 2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
Learned counsel for the writ petitioner, who is respondent No.1 in the writ appeal, prays for withdrawal of the writ petition itself with liberty to the writ petitioner to file application for her impleadment in Criminal Petition No. 7881 of 2015 or to file an independent Criminal Petition. Learned counsel for the appellant has no objection for granting such liberty. Criminal Petition No. 7881 of 2015 is filed by the father, mother and brother of the writ petitioner for similar relief, as prayed in the instant writ petition. Keeping that in view, we are inclined to allow the writ petitioner to withdraw the writ petition with liberty as prayed. Order accordingly.
The interim order, impugned in the present writ appeal, shall however remain operative for a period of two weeks from today. The interim order passed in W.P.M.P. No. 37745 of 2015 reads thus: "There shall be interim stay as prayed for only to the extent of petitioner."
It is made clear that this Court has not examined merits of the case. The writ petition and the writ appeal are disposed of. Consequently, pending miscellaneous applications shall also stand
closed.
