THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITOIN No.20716 of 2019 ORDER:

This writ petition is filed by the petition to issue a writ of mandamus to declare the inaction of the 2nd respondent in considering the application for building permission submitted by the petitioner to make construction in the open house plot, even after lapse of three months, as arbitrary and illegal.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. The case of the petitioner is that she made an application before the 2nd respondent - Panchayat Secretary, Korremula Gram Panchayat, for grant of building permission, but the 2nd respondent is not considering the said application.

4. Since the application of the petitioner for grant of building construction permission is pending before the 2nd respondent, it is for the 2nd respondent to consider the said application and pass orders in accordance with law.

5. Hence, the writ petition is disposed of directing the 2nd respondent to consider the application of the petitioner and pass orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
