HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18203 of 2018 ORDER:
The petitioner aggrieved by the seizure of bore well by respondent Nos.5 and 6 in Plot No.1032 in Sy.No.395 of Narsingapur of Boinapalli Mandal, Rajanna Sircilla District (erstwhile Karimnagar District) through panc hanama, dated 23.05.2018, has filed the instant writ petition. The principal ground of challenge is that the panchanama is neither preceded by a notice nor opportunity as is required by the WALTA Act is provided to petitioner. Therefore, the writ petition is filed without even availing remedy of statutory appeal. Learned Assistant Government Pleader submits that the contention of petitioner that no notice is issued is again a matter of verification and production of record by respondents 4 to 6. In stead of this Court entertaining the writ petition, the petitioner can be relegated to the remedy of appeal and in the interregnum suitable arrangement can be made to meet the ends of justice.
I have taken note of the respective submissions. Having regard to the above circumstances, the writ petition is disposed of by this order.
(a) Panchanama dated 23.05.2018 is suspended for a period of two weeks from today. (b) The petitioner is given liberty to file appeal within one week from today by enclosing a copy of this order.
(c ) The appellate authority considers the prayer, if any made by petitioner against the seizure of bore well, before the time granted by this Court.
The writ petition is disposed of accordingly. No order as to costs.
