THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CIVIL REVISION PETITION No.1491 OF 2021 ORDER:

This revision, under Section 227 of the Constitution of India, is filed by the petitioner/plaintiff aggrieved by the action of the learned Junior Civil Judge, Vemulawada, in not disposing of I.A.No.253 of 2020 in O.S.No.108 of 2020 pending on its file. 2.

Heard learned counsel for the revision petitioner/plaintiff and perused the record.

Learned counsel for the revision petitioner/plaintiff would contend that though the revision petitioner/plaintiff had filed I.A.No.253 of 2020 under Order XXXIX Rules 1 and 2 read with Section 151 of CPC one year back, the same has not been disposed of yet.

The material placed on record reveals that the subject I.A. is of the year 2020. The respondents/defendants also filed counter in the said I.A. In spite of the same, the said I.A. has not been disposed of by the Court below yet.

Under these circumstances, the learned Junior Civil Judge, Vemulawada, is directed to dispose of I.A.No.253 of 2020 in O.S.No.108 of 2020, pending on its file within thirty(30) days from today.

With the above direction, the Civil Revision Petition is disposed of.

The Miscellaneous Petitions, if any, pending shall stand closed. No costs.
