THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD W RI T PETI TI ON NO.9 9 5 6 OF 2 0 0 6 ORDER:
This writ petition is filed, seeking to call for the records relating to the orders passed by the Commissioner, Appeals, Land Administration, Hyderabad-1st respondent in Appeal No.BCW2/ 937/ 2003, dated 08-12-2005, confirming the orders passed by the Joint Collector,Chittoor-2nd respondent in D.Dis.No.(E4)18402/ 98, dated.10-10-2003 and to quash the same.
2.
The subject lands in the writ petition were originally assigned in favour of the petitioners and thereafter pattas were cancelled after following due process of law and the said lands were in turn given in favour of 120 eligible beneficiaries for house sites under Government welfare scheme. Aggrieved thereby, the petitioners moved the respondents by way of appeal and revision and they lost the battle before the respondents. 3.
Now, it is submitted by Smt.Krishna Veni, learned Assistant Government Pleader for Revenue (A.P) that since 1992 the petitioners have not been in possession of the subject lands and the same are in possession with the Government. Due to the status quo orders granted by this Court on 24-05-2006 in WPMP No.12573 of 2006, the Government is paralyzed in proceeding with implementation of its scheme in favour of 120 eligible beneficiaries.
4.
In view of the above submission made by the learned Assistant Government Pleader for Revenue, this writ petition is liable to be dismissed.
5.
Accordingly, the writ petition is dismissed while confirming the orders passed by respondents-authorities. No costs. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
