O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.3 of 2016 on the file of IV Additional Junior Civil Judge, Guntur, registered against the petitioner/ A-5 for the alleged offence punishable under Section 138 of the Negotiable Instruments Act. Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of C.C.No.3 of 2016 as expeditiously as possible, without insisting the presence of the petitioner/accused No.5 unless required for any specific purpose.
