WRIT PETITION NO. 730 OF 2007 O R D E R :
This writ petition is filed invoking the inherent jurisdiction of this Court under Article 226 of the Constitution of India seeking mandamus to declare the proceedings of the first respondent in Ref.G-3/2072/06, dated 11/12/2006 and the consequential declaration under section 6 of the Land Acquisition Act vide Ref.No.G-3/2072/06, dated 05/01/2007 issued by the first respondent pursuant to the notification under section 4 [1] of the Land Acquisition Act proposing to acquire the petitioner's land of an extent of 0-89 cents in survey Nos. 1133/6 and 1133/7 of Somidevarapalem village, Mummidivaram Mandal, East Godavari District vide E.G. 3/2072/06, dated 06/5/2006 as illegal, unjust, violative of the principles of natural justice and violative of the petitioner's rights guaranteed under Article 14, 19 [1] [g] and 21 of the Constitution of India and to set aside the same and to pass such other suitable orders as this Court may deems fit and proper in the circumstances of the case.
2. When the matter is listed today, it is represented by the learned counsel for the petitioners that subsequent to the filing of this writ petition, petitioners have surrendered their land and they got compensation and
nothing survives for adjudication, therefore, the matter has become in fructuous.
3. Recording the above submission, this writ petition is accordingly dismissed as infrucutous. No costs.
4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stands closed.
