HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.9804 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the proceedings dated 26.03.2015 of the 5th respondent, as illegal and arbitrary and for a consequential direction to set aside the same.

3. Basing on the show cause notice issued by the Revenue Divisional Officer-4th respondent, the Tahsildar, Rajam Mandal-5th respondent, entrusted the distribution of the fair price shop relating to the petitioner to Sri Bhavani Self-Help Group of Gopalapuram Village. Since the authorisation of the petitioner is in force, the 5th respondent ought not to have entrusted the distribution of the essential commodities to some other fair price shop dealer. Moreover, there is no mention about the proceedings of the 4th respondent based on which the impugned order was passed by the 5th respondent.

4. In the circumstances, the writ petition is allowed by setting aside the impugned proceedings of the 5th respondent dated 26.03.2015. Miscellaneous applications, if any, shall stand closed. No order as to costs. __________________ R. KANTHA RAO, J Date: 15.04.2015 BSS
