HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11164 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the inaction of the 2nd respondent-Joint Collector (CS) in not considering and passing orders in Appeal and stay petition dated 30.03.2015 filed by the petitioner against the order of the 3rd respondent dated 16.03.2015 in suspending his authorisation, as illegal and arbitrary.
3. Against the order dated 16.03.2014 passed by the 3rd respondent-Revenue Divisional Officer, Kurnool, Kurnool district, where under the authorisation of the petitioner was suspended, the petitioner preferred an appeal to the 2nd respondentJoint Collector on 30.03.2015. Along with the said appeal, the petitioner also filed stay petition. The grievance of the petitioner is that the 2nd respondent has not passed any order in the stay petition. Since the appeal is pending with the 2nd respondent-Joint Collector, he is directed to dispose of the appeal filed by the petitioner against the order of the 3rd respondent dated 16.03.2015, in accordance with law, after giving opportunity of hearing to the petitioner, within a period of eight
(8) weeks from the date of receipt of a copy of this order.
4. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
