THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Writ Petition No.20739 of 2019 ORDER :

Heard the counsel for petitioner, and the learned Government Pleader for Revenue, for respondents.

The petitioner's grievance is that the 3rd respondent is refusing to register the document presented by him on the ground that a Gazette Notification R.R.No.83, dt.25.09.2013, was issued. 3.

The said Gazette Notification had been considered by this Court in Writ Petition No.4924 of 2019, dt.11.03.2019, wherein it was decided that documents presented by petitioner therein would be considered without reference to the said Gazette Notification by the Collector, Medchal, Malkajgiri District.

Having regard to the said order, and since it was also followed subsequently in Writ Petition Nos.13016 and 13045 of 2019, this Writ Petition is also disposed of directing the registering authority to receive the documents as and when they are presented by the petitioner; and process the same without reference to the Notification dt.25.09.2013 issued by the Collector, Medchal Division, Malkajgiri District.

In the event the said documents are found to be fit for registration, the registering authority shall complete the due formalities in accordance with law and release the document.

MSR,J wp_20739_2019 However, if he still finds any ground to exercise power under Section 76 of the Act of 1908 and refuse registration, he shall pass a reasoned order and communicate the same to petitioner. 6.

The said exercise shall be completed as expeditiously as possible, and in any event, not later than one (01) month from the date of receipt of copy of the order, be it from whatsoever source. 7.

It is also made clear that mere registration of the said documents would not confer title upon the property covered thereby, if it is otherwise wanting, and would not preclude the Government from taking appropriate steps as warranted by law, if it seeks to assert any right or title over the said land.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
