HCJ & AAR,J W.P.No.23723 of 2005 ORDER: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The petitioners had approached this Court seeking a direction for issuance of a writ of mandamus directing the respondents to take such steps as are necessary in the interests of the third respondent, which would lead to better administration of the Institution, and certainly for the peace and tranquillity of the area, by directing the respondent No.3 not to make any further admission of students into the Madarasa, pending resolution of other disputes concerning the Management, and administration by the Principal Secretary, Home Department.

However, according to the counter affidavit submitted by the respondent No.2, they have already constituted a Towliath Committee on 17.01.2005 for the proper administration, and supervisory function of the respondent No.3. The said statement made by the respondent No.2 has not been challenged by the petitioners.

Therefore, this Writ Petition has become infructuous, and it is, hereby, dismissed as infructuous.
