HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 18580 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 27.03.2018 in O.A.No. 5652 of 2015 passed by the 4th respondent - Andhra Pradesh Administrative Tribunal, Hyderabad, whereby the application filed under Section 19 of the Administrative Tribunals Act, 1985 seeking to set aside G.O.Ms.No.289, dated 07.08.2015 which was issued by the Government dismissing the petitioner from service without issuing any notice to him, has been dismissed. The learned counsel for the petitioner submits that the aforesaid Government Order is illegal, arbitrary and violative of principles of natural justice for the reason that the respondents have not issued any notice before dismissing the petitioner from service.
It is not in dispute that the petitioner was found guilty and convicted of each of the offences punishable under Sections 7 and 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988. In view of the conviction imposed on the petitioner for the aforesaid offences, the impugned order passed by the Tribunal, in our opinion, is perfectly justified and the same does not warrant any interference by this Court.
SKK,J & AKS,J WP_18580_2018 Hence, we find no merit in this writ petition and the same is accordingly dismissed. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
