THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.5678 OF 2022 AND COMMON ORDER:

These two Criminal Petitions are filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking regular bail to the petitioners, who are arrayed as Accused Nos.6 and 7 in Crime No.133 of 2002 on the file of Station House Officer, Cyber Crime Police Station, Rachakonda registered for the offences punishable under Sections 417, 429 and 420 of Indian Penal Code and Section 66 (C & D) of IT Act.

Heard learned counsel for the petitioners/Accused Nos.6 and 7 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Learned counsel for the petitioners submits that the mandatory period of 60 days would be complete today i.e. from the date of arrest.

In the said circumstances, in the event of completion of the mandatory period, it is for the petitioners to move the trial Court under Section 167 Cr.P.C seeking bail.

Accordingly, the Criminal Petitions are disposed off granting liberty to the petitioners to move the concerned Court by filing application under Section 167 Cr.P.C. and upon such filing the concerned Court shall dispose it off on the very same day, keeping in view that the indefeasible right which accrues to accused on completion of mandatory period as prescribed under Section 167 Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
