HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 IN/AND CRIMINAL PETITION No.5987 of 2019 ORDER:
1) The petitioners, who are accused in S.C.No.127 of 2019 on the file of Principal Assistant Sessions Judge-cum-Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar, filed this Criminal Petition under Section 482 Cr.P.C. to quash the proceedings in the above S.C. A charge sheet came to be filed against the petitioners for the offences punishable under Sections 307, 290, 506 r/ w 34 IPC.
2) During pendency of the Criminal Petition, I.A.Nos.2 and 3 of 2019 came to be filed by the second respondent to record the compromise and to compound the offences. Along with the petitions, a joint memo came to be filed, inter alia stating that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the compromise. The said joint memo has been supported by the affidavit of the second respondent. In view of the settlement arrived between the parties as per the MOU dated 05.09.2019, today the accused have handed over the demand draft drawn on HDFC, Nacharam Branch, for a sum of Rs.30,00,000/ - to the defacto complainant to which she acknowledges to have received the same. As per the MOU, the total settlement was for Rs.1,30,00,000/ -. Out of which, the defacto complainant had already received a sum of Rs.70,00,000/ -
on the earlier occasions which was also acknowledged by the defacto complainant to have received the amount. The balance sum of Rs.30,00,000/ - has been agreed and shall be paid by the accused to the defacto complainant on the date when the decree for dissolution of marriage will be granted by the Court concerned. The MOU dated 05.09.2019 shall form part of the record. 3) Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioners.
4) In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.2 and 3 of 2019 are ordered.
5) Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in S.C.No.127 of 2019 on the file of Principal Assistant Sessions Judge-cum-Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar, against the present petitioners are hereby quashed.
