HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.20794 OF 2019 ORDER:
This Writ Petition is filed to declare the action of respondents in threatening the petitioner by calling to the 4th respondent police station repeatedly and threatening to pay the amount to the 5th respondent, as being illegal, arbitrary and violative of Articles 14, 19 19(1)(G) and 21 of the Constitution of India.
Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Home.
Learned Assistant Government Pleader for Home, on written instructions dated 24.09.2019, submits that basing on the complaint of one Rishika Reddy, a case was registered in Crime No.1019 of 2019 under Sections 498-A, 420 read with 34 IPC of L.B. Nagar police station on 06.09.2019 against three persons and the petitioner No.1 is arrayed as accused No.1 therein. During the course of investigation, the Investigating Officer tried to serve notice under Section 41-A Cr.P.C. to the accused persons, but the petitioners instead of taking notice under Section 41-A Cr.P.C. and cooperating with the investigation, filed the present Writ Petition with false and frivolous allegations to escape the case.
Inasmuch as the case of the petitioner is that the petitioners are being called to the police station without there being a case was registered against him, which in view of the facts recorded above appears to be incorrect. Thus, having regard to the fact that a Crime No.1019 of 2019 is registered and pending investigation against the petitioner, no further orders need be passed in the present Writ Petition. Accordingly, this Writ Petition is closed. No order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
