THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3547 of 2016 ORDER:
This Criminal Petition, under Section 482 Cr.P.C., is filed by the Petitioner seeking to quash the proceedings in D.V.C.No.242 of 2015 on the file of the IV Additional Chief Metropolitan Magistrate, Hyderabad.
Heard and perused the material available on record. The 2nd respondent - de facto complainant filed the present complaint against the petitioner and another seeking certain reliefs under the provisions of Protection of Women from Domestic Violence Act. Hence, this Court is not inclined to interfere with the further proceedings against the petitioner.
After arguing for some time, learned counsel for the petitioner while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.
In view of the submission of the learned counsel for the petitioner and considering the nature of allegations wherein the question of identity of the petitioner does not arise, his presence before the trial Court is dispensed with except on the dates the learned trial Judge insists for his presence same and the petitioner shall be properly represented by his counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions filed in this Criminal Petition, if any, shall stand closed. _______________ RAJA ELANGO, J March 16, 2016.
