THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30119 of 2010 ORDER:

This writ petition was filed challenging the demand notice dated 19.11.2010 issued by respondent No.4 for payment of Rs.29,59,900/- towards 10% of additional licence fee for the years 2006-2007 to 2010-2011 in respect of licence bearing No.8/20062007 as contrary to Rule 10 of the A.P.Excise (Grant of licence of selling by Bar and conditions of licence) Rules, 2005. An identical issue came up for consideration before this Court in W.P. No.13043 of 2010 and the said writ petition was disposed of with certain directions by order dated 19.03.2014. Since the relief sought for in the present writ petition was identical, this Court is inclined to dispose of this writ petition with the following directions:

The petitioner is directed to submit his explanation treating the present demand notice as a show cause notice within a period of one month from the date of receipt of a copy of this order and respondent No.4 shall consider the explanation submitted by the petitioner and pass appropriate orders thereon within a period of two months from the date of receipt of explanation. The amount of Rs.2,80,000/- deposited by the petitioner would abide by the orders passed by respondent No.4.

With the above directions, this Writ Petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
