THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.13025 of 2004 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in not regularizing the petitioner's service as 'Male Staff Nurse' with effect from the date of completion of five years of services in the 4th respondent's college as illegal, arbitrary and consequently directing the respondents to regularize the petitioner's service with consequential benefits and to pass such other necessary orders. At the time of hearing, learned counsel for the petitioner submitted that the purpose of filing the writ petition becomes infructuous.

In view of the submission made by the learned counsel for the petitioner the writ petition is dismissed as infructuous. However, the dismissal of this writ petition does not preclude the petitioner to avail the remedies available to him under law.

Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
