This appeal is filed under Section 100 of CPC, by the plaintiff, assailing the decree and judgment dated 05.2.2004 in A.S.No.45 of 2001 on the file of the Court of IV Additional District and Sessions Judge, Fast Track Court, Ranga Reddy District at L.B. Nagar, wherein and whereby the decree and judgment dated 15.6.2001 in O.S.No.614 of 1994 on the file of the Court of Principal Junior Civil Judge, Hyderabad East & North, Ranga Reddy District, NTR Nagar, Hyderabad, decreeing the suit for perpetual injunction, was set aside.

At the time of hearing, learned counsel for the appellant seeks permission of the Court to permit the appellant to withdraw the appeal as the matter was settled out of court. A letter dated 12.10.2018, to that effect, was addressed to the Registry. Permission is granted.

Accordingly, the second appeal is dismissed as withdrawn. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
