Petition under Article 226 oI the Constitution of lndia praying that in the circumstances stated in the affidavit filed, therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction more particularly one in the nature of Wrrt of Habeas Corpus to produce the 2 minor sons of the Petitioner herein namely
(1) Master T.Sriram, aged about 7 years, (2) Master T.Nishant, aged about 6 years from the custody of the unofficral Respondent Nos.B, 9 and 10, as it is illegal, arbitrary and violative of not only Articles 14 and 21 of the Constitution of lndia and also the Orders passed in W.P.No.25541 o't 2022, dated 30-06-2022 and consequently DIRECT the Respondents to produce the 2 minor sons of the Petitioner herein before this Hon'ble Court and hand over the 2 Minor Sons of the Petitioner's in letter and true spirit of the Orders passed in W.P.No 25541 oI 2022, dated 30-06-2022.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing-the arguments of SRI M V S SAI SHARATH Advocate for the Petitioner and AGP for Home for the Respondents 1 to 7, the Court made the following.
ORDER:
Heard the learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 perused the record.
Assistant to 4 and This Court, vide order, dated 't1.08.2022, permitted the petitioner to take out personal notice to the unofficial respondents. The petitioner filed Memo, dated 20.08.2022, along with the postal track consignment details of the notices sent to the unofficial respondents. ln the said postal track consignments, it is mentioned as 'door locked'. Further, there is an order in favour of the petitioner in relation to the custody of the minor children vide order, dated 30.06.2022, passed in W.P.No.2554'l ot 2022. Under these circumstances, the respondent No.4-Station House Officer, Ameenpur Police Station, Sangareddy District, is directed to produce the minor children, namely Master T.Sriram, aged about 7 years, and Master T.Nishant, aged 6 years, before this Court on the next date of hearing. Post on 01-09-2022.
