ORDER

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.

This writ petition is filed seeking to declare the action of the 3rd and 4th respondents in not considering the representation of the petitioner dated 25.4.2015 and not supplying the essential commodities to her fair price shop, as arbitrary and illegal. Petitioner was appointed as dealer of fair price shop No.40, Ravulacheruvu, Dharmavaram Mandal, Anantapur District, on permanent basis and her authorization was renewed from time to time. While so, on 24.4.2015, the police and vigilance authorities inspected the fair price shop of the petitioner and seized the stock on certain irregularities.

It is the case of the petitioner that though she submitted challan for renewal of her authorization, no orders were passed by the respondents. Since the petitioner has submitted challan within the time, she was under the impression that the authorization was renewed. However, when the respondents intimated that the authorization of the petitioner was not renewed, she submitted a representation dated 25.04.2015. But, so far no orders have been passed thereon. Challenging the said inaction, the present writ petition was filed. Learned Government Pleader for Civil Supplies has taken two adjournments for getting instructions. Today when the matter is taken up, learned Government Pleader states that so far

he has not received any instructions in the matter. In the circumstances, the 3rd respondent is directed to consider and dispose of the representation dated 25.4.2015 made by the petitioner for renewal of her authorization, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. However, if the authorization of the petitioner is renewed, the respondents are directed to supply the essential commodities for distribution, if no cases are pending against her.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
