Heard.

The petitioner states that he is the owner of TVS XL Super bearing No.TS-05-EC-2104, which is alleged to have been involved in Cr.No.601 of 2014-15. The petitioner also states that since 11-012015, the said vehicle is in the custody of the 4th respondent and it is exposed to sun and rain and it is getting spoiled. As such, the petitioner seeks a direction to the 4th respondent for release of the said vehicle.

Apparently, the petitioner has not approached the 3rd respondent by making any application seeking release of the vehicle in question. Hence, the Mandamus as sought for cannot be issued. The petitioner therefore is at liberty to make an appropriate application before the 3rd respondent seeking release of the vehicle and if any such application is made, the 3rd respondent shall consider the same and pass appropriate orders thereon expeditiously, preferably within one week from the date of receipt of such application. Accordingly, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
